Procedural Posture

Originating Summons / Ruling on Service and Setting Aside Proceedings

  1. 1 Whether the applicant is the lawful purchaser of the three plots in Bahati/Kabatini Block 1/2563.
  2. 2 Whether the said plots should be transferred to the applicant.
  3. 3 Whether the administrator/respondent should execute transfer documents for the applicant.

Ratio Decidendi

The court found that there was no evidence that the respondent, as administrator of the estate, was duly served with the Originating Summons. Service of process is a core requirement in all court proceedings to ensure that parties are given an opportunity to be heard. In the absence of proof of service, the court cannot proceed to grant the substantive orders sought by the applicant, as doing so would violate the respondent's right to a fair hearing. Consequently, the proceedings of 13th May 2015 were set aside, and the applicant was directed to properly serve the respondent before the matter could proceed further.

Court Disposition

Proceedings set aside pending proper service of Originating Summons on the respondent.

Orders

  • The proceedings of 13th May 2015 in respect of the Originating Summons are set aside.
  • The respondent shall be served with the Originating Summons.
