The court found that although the applicants did not provide compelling reasons for the delay in filing their appeal, the right of appeal is a constitutional right and procedural technicalities should not bar access to justice. Exercising its discretion under Article 159(2)(b) of the Constitution, the court allowed the application for extension of time, granting the applicants 60 days from the date of the ruling to file their intended appeal. Each party was ordered to bear its own costs.
