Ratio Decidendi

The court held that both the Kaloleni Land Disputes Tribunal and the Coast Provincial Appeals Committee acted outside their statutory jurisdiction by determining the issue of ownership of land, which was expressly excluded by Section 3(1) of the Land Disputes Tribunal Act. The proper forum for such disputes was the Magistrates courts or the High Court. As a result, the decisions of both the Tribunal and the Appeals Committee were ultra vires and could not stand. The court therefore allowed the appeal and set aside the impugned decisions.
