The correct legal framework is the Children’s Act, which replaced the Children and Young Persons Act and expressly excludes children’s homes from the definition of a school under the Education Act. Under Section 61 of the Children’s Act, only trustees, whose details must be supplied to the Director of Children’s Services, have the legal capacity to sue or be sued on behalf of a children’s home.
