The Defendant subsequently acknowledged his obligation to refund the sum by entering into a written agreement dated 13th February, 2009. The Defendant failed to honor this agreement and did not provide any evidence to rebut the Plaintiff's claims or to show that the land was registered in the Plaintiff's name. The court concluded that the Plaintiff was entitled to a refund of the purchase price and associated costs, together with interest and costs of the suit.
