Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the Claimant was on probation or confirmed in employment at the time of termination.
  2. 2 Whether there were valid reasons to terminate the Claimant.
  3. 3 Whether the Respondent followed due process before terminating the Claimant’s services.

Ratio Decidendi

The court found that the Claimant was confirmed in employment after the probation period lapsed without communication from the Respondent. The Respondent failed to provide a valid reason for termination and did not follow due process as required by law, including the absence of a formal hearing and written termination letter. The Respondent also failed to produce evidence disputing the Claimant's overtime claims or muster roll records. Consequently, the termination was held to be unfair and unjustified under Sections 41, 43, and 45(2) of the Employment Act, 2007. The Claimant was entitled to notice pay, overtime, and prorated leave as pleaded, with costs and interest.

Court Disposition

Claim allowed in part; termination declared unfair; monetary awards granted.

Orders
