Ratio Decidendi

The court found that although the sentence of ten years imprisonment was lawful for the offence of assault causing grievous bodily harm, the trial magistrate failed to consider relevant mitigating factors, namely the appellant's plea of guilty and his status as a first offender. The court held that these factors warranted a more lenient sentence, such as the option of a fine. Consequently, the court set aside the original sentence and substituted it with a fine of Kshs. 30,000, or in default, five years imprisonment, finding the original sentence excessive in the circumstances.
