The court further held that the issue of entitlement to the suit property between the Plaintiff and the 3rd Defendant could be determined in H.C.C.C No. 1719 of 1996 or thereafter if still outstanding. Given that H.C.C.C No. 1719 of 1996 was substantially part-heard, consolidation was not possible.
