The Tribunal found that the claimants failed to rebut the respondents' evidence that a lawful inquiry by the Commissioner of Co-operatives led to their removal and the election of new officials on 11.10.2018. The High Court orders did not expressly reinstate the claimants or bar the respondents from office, and the Tribunal was empowered to set aside interim orders in light of new circumstances. Given the need for continuity in the management of the 1st respondent, especially during the COVID-19 pandemic, and the lack of challenge to the surcharge and removal process, the Tribunal declined to grant the claimants' application for injunctive relief.
