Procedural Posture

Civil Application / Ruling on Motion to Strike Out Appeal

  1. 1 Whether the appeal should be struck out for failure to include a valid decree as required by the rules of court.
  2. 2 Whether the defect in the decree can be cured by amendment or supplementary record of appeal.

Ratio Decidendi

The court found that the decree included in the record of appeal was defective because it did not state the particulars of the claim as required by Order 20 Rule 6(1) of the Civil Procedure Rules. The defect was fundamental and could not be cured by amendment or by filing a supplementary record, as decrees are primary documents under Rule 85(2A) of the Court of Appeal Rules. Since the appeal lacked a valid decree, it was incurably defective and had to be struck out. The court therefore allowed the motion to strike out the appeal on this ground alone, without considering the second issue regarding the timeliness of the appeal.
