Ratio Decidendi

The High Court, by virtue of the Constitution of Kenya, 2010 and the Industrial Court Act, no longer has jurisdiction to hear and determine employment and labour relations disputes except for cases where hearing had already commenced prior to the establishment of the Industrial Court under the new constitutional framework. Since the hearing in this suit had not commenced, the transitional provisions do not apply to retain jurisdiction in the High Court. Therefore, for proper administration of justice and in accordance with the constitutional and statutory framework, the suit must be transferred to the Industrial Court, which has exclusive jurisdiction over such matters.
