The court found that the Petitioners, as county chief officers, held public service positions whose tenure was not dependent on the term of the appointing Governor. The County Governments Act does not empower the Governor or County Secretary to terminate chief officers; only the County Public Service Board can do so after following due process. The Petitioners' termination was effected without valid reason, without a hearing, and in contravention of Articles 41 and 236 of the Constitution and relevant statutory provisions.
