The court found that underpayment of wages below the prescribed minimum wage constitutes a continuing injury for the purposes of section 90 of the Employment Act, 2007. As such, the limitation period runs from the cessation of the injury, which in this case was the termination of the Claimant's employment on 22 July 2014. Since the claim was filed on 18 November 2014, it was within the 12-month period after cessation of the injury. The court also recognized that each underpayment could be a distinct cause of action, but where underpayments are continuous, the limitation period applies from the end of the employment.
