The court found that the decree from the Webuye Land Disputes Tribunal in case no. 16 of 2002 was still in force, as the defendants' challenge to it had been struck out and no evidence was provided to the contrary. However, the plaintiff failed to prove fraud on the part of the defendants in the acquisition and subdivision of the suit land. The court held that the burden of proving fraud is higher than on a balance of probabilities and must be strictly discharged, which the plaintiff did not do.
