The court found that the recognition and enforcement of the arbitral award was procedurally defective because the respondent failed to file the original arbitration agreement or a certified copy as required by section 36(2) of the Arbitration Act. Additionally, the applicant was not served with the application for recognition and enforcement, thereby being denied the right to be heard under section 37 of the Act.
