Procedural Posture

Criminal Appeal / Judgment

  1. 1 Whether the charge sheet was fatally defective for omitting the words 'intentionally' and 'unlawfully'.
  2. 2 Whether the appellant's constitutional rights under Article 49(1)(f) were violated by delayed arraignment.
  3. 3 Whether the age of the complainant, a key ingredient of defilement, was proved beyond reasonable doubt.

Ratio Decidendi

The conviction for defilement under section 8(3) of the Sexual Offences Act was unsafe because the prosecution failed to prove the complainant's age beyond reasonable doubt, given conflicting evidence from the complainant and her mother and the absence of documentary proof such as a clinic card. However, the evidence, including the appellant's own admission and DNA results, established that the appellant committed an indecent act with a child. The court therefore quashed the conviction for defilement and substituted it with a conviction for indecent act with a child under section 11(1) of the Sexual Offences Act, sentencing the appellant to ten years' imprisonment.

Court Disposition

Conviction for defilement quashed; conviction for indecent act with a child substituted; sentence of 10 years' imprisonment imposed.

Orders

  • The conviction for defilement contrary to section 8(1) and 8(3) of the Sexual Offences Act is quashed.
  • The sentence of twenty four (24) years imprisonment is set aside.
