Procedural Posture

Land Case / Ruling on Objection to Representation

  1. 1 Whether the plaintiffs can be represented by two law firms acting 'alongside' each other without a notice of change of advocate.
  2. 2 Whether the appointment of Bungei & Murgor & Co. Advocates is irregular or contrary to Order 9 Rule 5 of the Civil Procedure Rules.

Ratio Decidendi

The court held that there is no irregularity in a party appointing more than one firm of advocates to act in a matter. The filing of a notice of appointment merely adds an advocate to the record and does not require the removal of the original advocate unless a notice of change is filed. The rules do not prohibit advocates from acting 'alongside' each other, and the absence of objection from the original firm supports the propriety of the arrangement. The objection to Mr. Bungei's representation was therefore disallowed, and the hearing was ordered to proceed.
