The legal representative of the estate of the original defendant, Yunia Aoko Miyogi, was Ododa Erick Miyogi, who had been issued a grant of letters of administration. As such, the application was brought by a person without legal capacity, rendering it fatally defective. The court further held that only a duly appointed legal representative can act on behalf of a deceased's estate in legal proceedings.
