In the absence of direct evidence and with the only eyewitness (PW3) not present at the scene, the court held that liability should be apportioned equally at 50% to each party. Regarding damages, the court upheld the use of the global approach for loss of dependency due to the deceased's age and status as a minor, but found the trial court's award of Kshs.1 million excessive, reducing it to Kshs.500,000.
