Although the court could not determine the arguability of the appeal due to insufficient material, it accepted the appellants' explanation regarding lack of funds and willingness to raise money if the appeal failed. In the absence of opposition from the respondent, the court exercised its discretion to grant the stay, conditional upon the deposit of Kshs. 50,000 as security for costs within 30 days, failing which the stay would lapse.
