Notice of Motion Application / Ruling on Contempt Application

  1. 1 Whether the 2nd interested party was in contempt of court orders issued on 9th July, 2019.
  2. 2 Whether the injunctive orders were directed at the 2nd interested party or only the plaintiff/respondent.
  3. 3 Whether sufficient notice and evidence of contempt was provided against the 2nd interested party.

Ratio Decidendi

The court found that the injunctive orders issued on 9th July, 2019 were explicit and directed solely at the plaintiff/respondent, not the 2nd interested party. The 2nd interested party was not a party to the suit at the time the orders were made, and there was no evidence that they had been served with or had personal knowledge of the order. The applicant failed to prove beyond reasonable doubt that the 2nd interested party had notice of the order or wilfully disobeyed it. Given the serious nature of contempt proceedings, the court held that the threshold for citing the 2nd interested party for contempt was not met. Accordingly, the application for contempt was dismissed for lack of merit.
