Ratio Decidendi

The pending application by Spire Properties (Kenya) Limited for joinder as an interested party was filed and served before the consent letter was signed. None of the parties filed any opposition to the application or demonstrated any prejudice that would result from the joinder. The court found that it retained jurisdiction to hear and determine the application, and that Spire Properties had demonstrated sufficient interest in the subject matter of the suit.
