The court found that the application for leave to apply for orders of certiorari and prohibition was filed outside the statutory six-month period required for challenging the proceedings or orders in question. The adoption of the Tribunal award as a judgment of the court occurred on 2nd December 2002, and the application was filed on 21st January 2010, well beyond the prescribed limitation period. As such, the court held that the application was time-barred and could not be entertained, regardless of the merits of the allegations regarding excess of jurisdiction by the Resident Magistrate. The application was therefore dismissed.
