Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the respondent's suit was statute barred under section 90 of the Employment Act, 2007.
  2. 2 Whether the leave granted to file the suit out of time was valid and effective at the time of filing the suit.
  3. 3 Whether the trial court erred in refusing to strike out the suit for being time barred.

Ratio Decidendi

The court found that the respondent filed her suit after the expiry of the 60-day period granted by the court for filing out of time. Since the leave had lapsed and there was no evidence of an extension or further leave, the suit was filed without valid leave and was therefore statute barred under section 90 of the Employment Act, 2007. The trial magistrate erred in failing to consider that the leave had expired and in refusing to strike out the suit. The cited authority regarding leave to file out of time did not apply because the leave was no longer effective at the time of filing. Consequently, the appeal succeeded and the respondent's suit was struck out as time barred.

Court Disposition

Appeal allowed. Respondent's suit struck out as statute barred. Costs awarded to appellant.
