The court found that the Plaintiff's caveat was not properly registered, as the entry was unsigned and cancelled, and thus did not confer any rights or prevent dealings with the Suit Property. The Plaintiff entered into a sale agreement for land that was already charged to a bank, without obtaining the required written consent from the chargee, in contravention of Section 87 of the Land Act. The Plaintiff's agreement lapsed and was not extended, and he failed to obtain the necessary consents. The 2nd Defendant, as chargee, lawfully exercised its statutory power of sale after default, selling the property by public auction to the 3rd and 4th Defendants, who became registered proprietors....
