The court found that the applicants had provided a reasonable explanation for the delay in filing the appeal, as judgment was delivered without notice to the parties and the delay was not inordinate. The court exercised its discretion to grant leave to appeal out of time. On the issue of stay of execution, the court held that while the applicants may suffer substantial loss if stay is not granted, the respondent is also entitled to enjoy the fruits of his judgment. To balance the interests of both parties, the court ordered that half of the decretal sum and costs be paid to the respondent within thirty days, with the balance to await the outcome of the appeal.
