The applicant took steps to file the notice of appeal and request proceedings in time, and would suffer prejudice if denied the right to appeal. The respondent did not oppose the application. In the interests of justice and considering the applicant's right of appeal, the court exercised its discretion to grant extension of time for service of the request for proceedings and for filing and serving a new record of appeal.
