Procedural Posture

Employment Appeal / Judgment

  1. 1 Whether the respondent was unfairly terminated from employment.
  2. 2 Whether the appellant followed due process in disciplining and suspending the respondent.
  3. 3 Whether the compensation awarded by the trial court was justified and proportionate.

Ratio Decidendi

The court found that the appellant failed to provide evidence of a disciplinary hearing, customer complaints, or redeployment after suspension, and did not discharge the statutory burden to prove valid reasons and fair process for termination. However, the court held that the trial magistrate erred in awarding the maximum compensation of 12 months' salary, given the respondent's short service, lack of special skills, and subsequent employment. The compensation was therefore reduced to six months' salary. The appeal succeeded only to the extent of reducing the compensation, with the rest of the appeal dismissed.

Court Disposition

Appeal partially allowed; compensation reduced; remainder of appeal dismissed.

Orders

  • Award of 12 months' compensation set aside and substituted with six months' salary (Kshs.44,400) as compensation for unfair termination.
  • No order as to costs.
