The Tribunal held that the inconsistent and sporadic rent payments by the Tenant were insufficient to imply a periodic tenancy or a landlord-tenant relationship. Furthermore, the Rent Inspector's report confirmed that the Tenant was not in occupation of the premises at the time of inspection. Without a subsisting tenancy, the Tribunal could not exercise jurisdiction under the Act.
