The Employment and Labour Relations Court lacks jurisdiction to adopt an award of the Director of Occupational Safety and Health under the Work Injury Benefits Act as a judgment of the court through a miscellaneous application. The statutory framework under WIBA provides only for appellate jurisdiction by way of appeal against the Director's decision, not for enforcement or adoption of the award by the court. There is no provision in WIBA or any other law that allows the court to execute or adopt the Director's award as its own order. The application to adopt the Director's award is therefore irregular and must be struck out for want of jurisdiction.
