The court found that the applicant had provided sufficient reasons for the delay in filing the appeal, namely the inability to obtain the judgment and certified proceedings in time despite diligent efforts. The court was satisfied that the delay was not deliberate and that the applicant acted promptly upon obtaining the necessary documents. The court also noted that the respondents had not demonstrated any prejudice they would suffer if the application was granted. Exercising its discretion under Sections 79G and 95 of the Civil Procedure Act, and guided by relevant case law, the court allowed the application for enlargement of time and deemed the appeal properly filed and served.
