Procedural Posture

Criminal Appeal / Second Appeal From Conviction and Sentence

  1. 1 Whether the first appellate court failed in its duty to re-evaluate and reassess the evidence afresh as required by law.
  2. 2 Whether the conviction for attempted robbery with violence was supported by evidence beyond reasonable doubt.
  3. 3 Whether the appellant was properly identified as one of the perpetrators of the offence.

Ratio Decidendi

The Court of Appeal found that the first appellate court properly re-evaluated the evidence and was correct in upholding the conviction. The appellant was positively identified as one of the three persons who attempted to rob the complainant while armed with a homemade gun. The sequence of events, including the immediate chase and arrest by police, left no break in the chain of evidence. The appellant's defense that he was only in possession of the firearm for sale was rejected, as he used the gun to threaten the complainant during the attempted robbery. The court concluded that the prosecution had proved the charge beyond reasonable doubt and that there was no merit in the appeal.
