The court found that the applicant's prayer seeking to prohibit the respondent from proceeding with the charges had already been determined in a previous constitutional petition and could not be re-litigated. However, the court held that there was valid reason to grant leave for judicial review in respect of the warrant of arrest issued on 23rd May 2012, as the applicant alleged he had already been served with summons to appear for plea.
