The Court found that the applicant had demonstrated an arguable point on appeal regarding the ownership of the disputed land, supported by documentary evidence of purchase and payment of rates. The Court further held that, despite the respondent's assertion that he would not evict the applicant, his stated intention to enter and develop the land created a real risk that the appeal could be rendered nugatory if stay was not granted. In the interests of justice and to preserve the status quo pending the hearing and determination of the intended appeal, the Court granted the stay of execution of the ELC judgment and consequential orders.
