Ratio Decidendi

The court found that the applicant failed to establish both limbs required for the grant of a stay under rule 5(2)(b) of the Court of Appeal Rules. First, there was no arguable appeal because the applicant did not participate in the disciplinary process and the judgment merely dismissed her petition without restraining any action or ordering anything to be done. Second, the intended appeal would not be rendered nugatory as the applicant's employment had already been terminated and any loss suffered could be compensated by damages if the appeal succeeded. There was therefore nothing left to stay, and the application was dismissed for lack of merit.
