The court found that the plaintiff had failed to establish a right to the additional 3 acres of land and was a trespasser on the 1st defendant’s property. The court held that the plaintiff would suffer substantial loss if evicted from the portion of land used for parking and access to the church building before the appeal is determined, but not in respect of the remainder of the disputed land or the monetary awards. The court therefore granted a partial and conditional stay of execution limited to the parking and access area, subject to the plaintiff depositing Kshs. 1,000,000 in court within 30 days. The stay was denied for the monetary awards and as against the 2nd and 3rd defendants....
