Ratio Decidendi

The court found that the applicant was entitled to judgment for the taxed costs of KES 169,000 as there was no dispute on retainer and the costs had been duly taxed and certified. However, the applicant was not entitled to interest at 9% per annum prior to judgment because it had not demonstrated compliance with paragraph 7 of the Advocates (Remuneration) Order, specifically that a claim for interest had been raised with the respondent.
