Although the suit ought to have been filed in Mombasa under Section 15 of the Civil Procedure Act, the applicant voluntarily submitted to the jurisdiction of the Nakuru Children’s Court by filing a defence and participating in proceedings since 2019. The applicant is therefore estopped from challenging jurisdiction at this late stage. The court found no sufficient grounds to transfer the suit, especially as the matter is at an advanced stage and virtual hearings mitigate inconvenience.
