Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the appeal was competent given the change of advocates without leave of court.
  2. 2 Whether the appeal could proceed after a winding-up order without leave of court.
  3. 3 Whether the award of Kshs. 300,000/= in general damages was excessive in the circumstances.

Ratio Decidendi

The appeal was found incompetent because the appellant's new advocates, M/s Nyaundi Tuiyot & Company, came on record without leave of court as required by the Civil Procedure Rules. Additionally, after a winding-up order was made against the appellant, no leave of court was obtained to proceed with the appeal, contrary to section 228 of the Companies Act. Even if the appeal were competent, the court found no basis to interfere with the trial court's award of Kshs. 300,000/= in general damages, as it was not so excessive as to warrant appellate intervention. The appeal was therefore dismissed, and the decretal sum held in the joint account was ordered to be released to the respondent.
