The court found that the claimant's termination was unlawful and null and void because he was not given a hearing as required by Section 41 of the Employment Act 2007 and the applicable Collective Bargaining Agreement. The claimant was entitled to be on half pay for six months and then on suspension without pay until the conclusion of the criminal case, with reinstatement and payment of withheld salary if acquitted. The letter of 6th April 2011 from the respondent constituted a reinstatement, not a new appointment, and the respondent's action of placing the claimant in a junior position with lower pay was contrary to Section 49(3) of the Employment Act.
