Ratio Decidendi

The court held that the law gives priority to the child of the deceased over grandchildren and spouses of the administrator in both administration and distribution of the estate. The protestors, being the son and first wife of the administrator, have no independent legal claim to the estate of the deceased; their rights are derivative through the administrator. The estate, consisting of MWERUA/MUKURE/857, must devolve solely upon the administrator as the only child of the deceased. Any subsequent sharing with his wives or children is a matter for the administrator after transmission, not for the court at this stage. The protest was dismissed as lacking legal merit.
