The court held that the Commissioner of Investigations and Enforcement is not a juristic person capable of being sued in his own name for acts done in the course of duty as an officer of the Kenya Revenue Authority (KRA). The Kenya Revenue Authority Act confers legal capacity to sue and be sued only on KRA as a corporate entity. Orders made against the Respondent in his personal capacity would be unenforceable and therefore in vain.
