Procedural Posture

Civil Appeal / Post Withdrawal Costs Application

  1. 1 Whether costs are payable to the respondent upon withdrawal of an appeal by the appellant.
  2. 2 Whether Order 24 of the Civil Procedure Rules applies to appeals as it does to suits.
  3. 3 Whether the appellant should be shielded from paying costs of the withdrawn appeal due to the pendency of a subsequent appeal on the same matter.

Ratio Decidendi

Order 24 of the Civil Procedure Rules does not apply to appeals, as it is limited to suits. The withdrawal of an appeal is governed by the court's discretion under Section 27(1) of the Civil Procedure Act, which provides that costs follow the event unless the court orders otherwise for good reason. The appellant's argument that costs should not be awarded because a subsequent appeal is pending is not persuasive, as each appeal is a distinct proceeding. There is no good reason to depart from the general rule that costs follow the event. Therefore, the respondent is entitled to the costs of the withdrawn appeal and the costs of the application for costs.

Court Disposition

Application for costs allowed.

Orders

  • The appellant shall pay to the respondent the costs of Civil Appeal No.1 of 2007 (the withdrawn appeal).
