The Court of Appeal held that it had jurisdiction to entertain the application because the applicant had lodged a Notice of Appeal within the prescribed time, and rule 77(4) of the Court of Appeal Rules, 2022 permits lodging a Notice of Appeal prior to obtaining leave where leave is required. The Court found that the applicant’s intended appeal was arguable, particularly on the issue of whether his property could be auctioned to satisfy a judgment in proceedings to which he was not a party. The Court further determined that if stay was not granted, the appeal would be rendered nugatory because the sale of the property, valued at over Kshs 400,000,000, to satisfy a much smaller decretal...
