The Plaintiff's claim for declaratory and injunctive relief could not be sustained in the absence of any actionable interest in the subject property. The court further held that the opposition documents filed by the Plaintiff were a nullity, having been filed out of time without leave of court, and thus could not be considered. The purported amended defence by the 1st Defendant was also a nullity for lack of signature and authentication....
