Procedural Posture

Civil Suit / Ruling on Post Judgment Transfer Application

  1. 1 Whether the court, being functus officio, can grant an order to transfer a suit to another court after judgment has been delivered.
  2. 2 Who should bear the costs of the application.

Ratio Decidendi

The court held that it was functus officio, having already delivered judgment on November 25, 2021, and therefore lacked jurisdiction to transfer the suit to another court for further hearing. The statutory provisions relied upon by the applicant contemplate transfer of cases pending trial, not those already concluded. Entertaining the application would require the court to revisit the merits of a decided dispute, which is prohibited by the doctrine of functus officio. The court further held that costs follow the event, and since the application failed, the 1st Defendant must bear the costs.

Court Disposition

Application dismissed for want of merit; court found itself functus officio and without jurisdiction to transfer the suit post-judgment.

Orders

  • The Notice of Motion application dated April 20, 2022 is dismissed.
  • The court has no jurisdiction to hear and determine the application based on the doctrine of functus officio, judgment having been pronounced on November 25, 2021.
