Civil Case / Ruling on Application to Strike Out Amended Plaint

  1. 1 Whether the plaintiff was entitled to join new parties to the suit by way of an amended plaint without leave of the court.
  2. 2 Whether the amended plaint dated December 15, 2022 should be struck out for improper joinder of parties.

Ratio Decidendi

The court found that its earlier ruling of October 18, 2022 did not grant the plaintiff leave to introduce new parties to the suit, but only permitted amendments in response to the amended defence. The addition of the 6th, 7th, and 8th defendants was therefore not sanctioned by the court and amounted to an abuse of process. The court emphasized that amendments should not be allowed where they cause injustice or circumvent statutory limitations. As such, the amended plaint was struck out for improper joinder of parties without leave of the court.

Court Disposition

application allowed; amended plaint struck out with costs

Orders

  • The amended plaint dated December 15, 2022 is struck out with costs.
  • Costs of the application awarded to the 1st defendant.
