Ratio Decidendi

The court held that jurisdiction is determined by the pleadings as filed. At the time of filing, the plaintiff's pleadings did not disclose that the value of the suit land exceeded the pecuniary jurisdiction of the Chief Magistrate's Court. It was only after the defence and valuation report were filed that the lack of jurisdiction became apparent. The court found that even if the suit was subsequently shown to be in the wrong court, the interests of justice and the overriding objectives of the Civil Procedure Act support the transfer of the suit to the competent court rather than requiring the plaintiff to withdraw and refile. The court rejected the argument that Section 18 does not apply...
