The Court found that the dispute at the heart of the suit is a boundary dispute, which by law must first be determined by the Land Registrar under Sections 18 and 19 of the Land Registration Act. The existence of a survey report from the Thika Survey Office does not substitute for the statutory requirement that the Land Registrar, after hearing all parties, must determine the boundary. The Court cannot usurp the Land Registrar's statutory mandate.
