Ratio Decidendi

The trial court imposed a sentence of Kshs 100,000 fine and two years' imprisonment in default, which exceeded the statutory maximum penalty under section 11 of the Trespass Act. The High Court found this sentence to be unlawful and illegal. The court held that its revisionary jurisdiction extended to correcting such illegality but not to reviewing the merits of the compensation order, which should be addressed on appeal. Consequently, the High Court set aside the illegal sentence and substituted it with the lawful maximum: a fine of Kshs 500 or two months' imprisonment in default. Any excess fine paid was ordered to be refunded to the applicant.
